Terms of service

These terms are the contract between you and GNK Services, trading as FillHost, for hosting, domains, email, and related services. Ordering, paying, or using a service means you accept them. If you order for a company, you confirm you can bind that company.

What we provide

WordPress, Linux, and Windows plans are the services with a published price. Dedicated servers, VPS, reseller hosting, business hosting, standalone email, domains, and paid SSL are provided only when a quote or order confirmation says so. A page on this website that does not show a price is not an offer.

Free hosting is for one current student and one account, for twelve months from the day the account is opened. It is not available to a business, it does not include a domain name, it does not renew for free, and the 30-day money-back guarantee does not apply because there is no hosting fee. We may refuse the request, and we may close the account when the year ends or if you are not a student.

Where a plan says storage, bandwidth, or databases are unlimited, we do not set an artificial cap for ordinary use. We may still throttle or suspend an account that harms the platform, other customers, or the network.

Your duties

You are responsible for your account, your customers, the content you host, the software you install, and the legality of all of it. You will keep login details secret and tell us promptly if you believe an account is compromised. You will give accurate identity and contact details, and update them when they change.

Acceptable use

You may not use the services to:

• send spam or unsolicited bulk email, or host a site that does;
• phish, spread malware, or run port scans, floods, or open relays;
• host material that is illegal in India, including child sexual abuse material;
• infringe copyright or other intellectual property;
• break into systems, or hide the origin of abuse;
• resell a non-reseller plan, or exceed a quota in the order.

Adult content is not allowed on shared plans, including WordPress, Linux, Windows, business, and reseller accounts. It is allowed on a dedicated server only if it is lawful and we have agreed in writing before you upload it. There is zero tolerance for content that breaks copyright law.

Spam, phishing, and malware are grounds for immediate termination. We do not have to give notice first if delay would harm the network or another person.

Suspension and termination

We may suspend or terminate a service for non-payment, a breach of these terms, a lawful request, or to protect the platform. You may cancel from the client area or from the contact page. Cancellation stops the next renewal. It does not by itself refund money already paid. See the refund policy.

Dedicated servers and VPS have a minimum term of one month. If you cancel before that term ends, you owe an early termination fee of USD 199, in addition to charges already incurred.

After termination we may delete the account. We do not promise to keep data, mail, or backups once a service is suspended or terminated. Export anything you need before you cancel.

Backups

Shared hosting, business hosting, and reseller hosting include a free weekly backup and one restoration in a calendar month. Further restorations are chargeable. VPS and dedicated servers do not include free backup or free restoration unless the quote says so.

A backup is a convenience, not a guarantee. If your site contains malware, or the service is suspended or terminated, we are not responsible for backup or data loss. You must keep your own copies.

Fees and renewal

You pay the price in the order confirmation, in the currency shown, plus taxes. Services renew for the same term unless you cancel before the renewal date. We may change the price of a later term; the price that applies is the one shown at renewal. Domain registry fees can change without matching a hosting price.

Non-payment can lead to suspension and then deletion. You still owe fees for the term already started, including the early termination fee where it applies. You may not withhold payment because of a dispute; raise the dispute separately.

No warranty

Services are provided as available. We do not warrant uninterrupted or error-free operation, that a particular application will run, or that email will be accepted by every other provider. Maintenance, upstream network faults, and denial-of-service attacks can cause downtime. Support is provided with reasonable care. A response time applies only if a written order states one.

Liability

To the fullest extent allowed by Indian law, GNK Services is not liable for lost profits, lost revenue, lost data, lost goodwill, or any indirect or consequential loss. Our total liability arising out of a service in any twelve-month period is limited to the fees you paid us for that service in the three months before the claim.

Nothing in these terms limits liability for fraud, or for death or personal injury caused by negligence, or any other liability that Indian law does not allow us to limit.

Your indemnity

You will indemnify GNK Services and its staff against claims, fines, and reasonable legal costs arising from your content, your customers, your breach of these terms, or your violation of law or someone else's rights. We will tell you of a claim that we expect you to cover, and we may control the defence.

Changes

We may update these terms by posting the new version on this page. The new version applies from the date shown. If you keep using the service after that date, you accept the update. The refund policy and privacy policy form part of this contract.

Law and disputes

These terms are governed by the laws of India. The courts at Chennai, Tamil Nadu, have exclusive jurisdiction, except where a statute gives a consumer a right to sue elsewhere. Use the contact page before starting a claim so we can try to resolve it.
